Acceptable use

Permitted use, prohibited conduct and account review.

Last updated November 5, 2026

Use your approved merchant account

Use the service only for the business, products, channels and locations approved for your account. Each party must comply with laws and payment method rules that apply to its activities. A binding legal, network or account restriction must not be evaded.

This policy forms part of the merchant agreement when selected. A restricted activity requires written approval before processing. Approval may include conditions, limits and an expiry date. No approval permits conduct prohibited by law, sanctions, binding network rules or the applicable acquiring program.

Prohibited conduct

Do not use the service for:

  • Illegal transactions, fraudulent investment or sales schemes, stolen goods, counterfeit products or knowing infringement of another person’s rights.
  • Transactions barred by applicable sanctions, concealment of a prohibited person or activity, or use of false identity, ownership, license or business information.
  • Fictitious sales, unauthorized charges, disguised cash advances, card testing, duplicate submission or deliberate evasion of network controls.
  • Processing for an undisclosed seller, disguising the true seller or routing transactions through another business or account to bypass a restriction.
  • Money laundering, knowing facilitation of criminal activity, unlawful pyramid schemes, deceptive payment collection or manipulation of refunds and disputes.
  • Unauthorized system access, harmful code, deliberate security interference or misuse of customer information.

Activities requiring written approval

Do not submit transactions for the activities below until Etail has issued specific written approval reflecting any required acquirer, provider or network approval. Lawful operation, a license, account access or a successful payment is not that approval. Some activities cannot be supported under the applicable program and will be declined.

Provide the business model, actual seller, products, licenses, customer terms, delivery timing and intended movement of funds. The approval must identify the merchant account, approved activity, payment methods, channels, territories, limits, conditions and any expiry date. Approval of one activity does not approve another business or seller.

Tell us before changing an approved activity, adding a seller, changing payment routing or introducing fund holding or onward transfers. Obtain written approval before processing the changed activity. Report a lost or suspended license or other loss of eligibility immediately and stop the affected processing until written approval to resume is given.

An industry example on this website, a referral or a software integration is not approval. Client money, trust accounts, escrow and payments for other sellers require the specific legal, account and provider arrangements that apply to them. They must not be processed through an ordinary merchant account merely because the platform can submit a payment.

  • Marketplaces, payment aggregation and sales or collections for other sellers, including commissions, split payments, escrow and holding or forwarding funds.
  • Shipping brokers, freight forwarders and related arrangements involving carrier payments, factoring or credit.
  • Travel agencies, booking platforms, tour operators and travel sold before delivery, including supplier collections and cancellation exposure.
  • Legal service payment arrangements involving client advances, retainers, trust or IOLTA accounts, bankruptcy services or creditor collections.
  • Financial services, lending, debt collection, debt relief, credit repair, insurance, investments, remittances and digital asset services.
  • Regulated healthcare, telehealth, pharmaceuticals, medical devices and products requiring professional or regulatory authorization.
  • Age restricted or otherwise controlled products and services, including alcohol, tobacco, cannabinoid products, weapons, adult content and gambling related activities where lawful.
  • Charitable fundraising, crowdfunding and collection of money for a beneficiary other than the merchant.
  • Stored value, gift cards, virtual currency, precious metals and other products whose main purpose is to store or transfer value.
  • Subscriptions, automatic renewals, free trials that convert to paid services, substantial advance payments, extended delivery, cross border activity or material increases in transaction volume outside the approved account scope.

Customer communications

Use accurate product descriptions, total prices and recognizable seller information. Disclose delivery, renewal, cancellation and refund conditions before purchase. Honor required customer remedies and keep evidence of the agreed terms.

Do not use misleading statements, concealed subscriptions, forced consent or threats to prevent a legitimate complaint or issuer dispute. Do not claim Etail, a bank or a network guarantees your products or endorses your business.

Review and corrective action

We may request records, licenses, customer disclosures and transaction evidence needed to assess compliance. Supply accurate information by the reasonable deadline stated and preserve relevant records. We may restrict or end affected processing under the Merchant Services Terms if an approval condition is breached, eligibility changes, required information is not supplied or a binding requirement applies.

Where permitted, we will explain the concern and available corrective steps. Processing may resume only after any required written approval; moving transactions to another account does not resolve the restriction.

Report suspected misuse to compliance@etaildepot.com with the account or website concerned and a brief description. Do not send customer credentials or sensitive records in the initial message.
